The purpose of this study is to determine empirically the state of the art of the medical care, when healthcare personal is confronted with ethical dilemmas related with the care they give to the geriatric population. An observational, longitudinal, prospective and qualitative study was conducted by analyzing the correlation between healthcare personnel–patient relationship, and ethical judgments regarding dilemmas that arise in daily clinical practice with geriatric patients. Mexican healthcare personnel with current active practices were asked to write up an ethical (...) dilemma that arose frequently or that had impacted their medical practice. From the narrative input, we were able to draw up a database with 421 dilemmas, and those corresponding to patients 60 years and older were selected. The axiological analysis of the narrative dilemmas of geriatric patients was made using dialectical empiricism. The axiological analysis values found most frequently were classified into three groups: the impact of healthcare, the roles of the physician, and refusal of therapy; the healthcare role of educator, caring for the patients’ life and the risk of imminent death where the values found more often. The persistence and universality of certain dilemmas in geriatrics calls for awareness and requires a good training in the ethical discernment of these dilemmas. This would help to improve substantially the care and the life quality of this population. (shrink)

In abstract argumentation, each argument is regarded as atomic. There is no internal structure to an argument. Also, there is no specification of what is an argument or an attack. They are assumed to be given. This abstract perspective provides many advantages for studying the nature of argumentation, but it does not cover all our needs for understanding argumentation or for building tools for supporting or undertaking argumentation. If we want a more detailed formalization of arguments than is available with (...) abstract argumentation, we can turn to structured argumentation, which is the topic of this special issue of Argument and Computation. In structured argumentation, we assume a formal language for representing knowledge and specifying how arguments and counterarguments can be constructed from that knowledge. An argument is then said to be structured in the sense that normally, the premises and claim of the argument are made explicit, and the relationship between the premises and claim is formally defined (for instance, using logical entailment). In this introduction, we provide a brief overview of the approaches covered in this special issue on structured argumentation. (shrink)

The sublime in classical aesthetics arrived at a famous formulation with Kant as a subjective quality more elevated than beauty, linked to commotion and respect followed by reaffirmation. However, a new interpretation of the Schopenhauerian sublime is necessary in its transforming appreciation of the importance of this feeling as a psychological state, which is not yet metaphysical as usually understood, when dealing with struggling situations without resolution. Here the focus will be on a variety of the sonorous sublime in contemporary (...) music, which finds resonances with Schopenhauer’s sublime: Witold Lutoslawski’s Three Poems of Henri Michaux for mixed chorus and orchestra focuses on unpredictability and form-contrariness, “picturing” surrealist texts of uncertainty in Pensées, violence in Le Grand Combat, and resignation in Repos dans Malheur. This article seeks to reconsider some colonial and contemporary readings around a paradigmatic figure: Malintzin. With this objective I will divide our approach into four correlated sections. The first introduces some elements around the construction of the term Malintzin, highlighting those that are related with the Nahua cultural world. The second takes up the colonial chronicles of Bernal Díaz del Castillo and Diego Muñoz Camargo, identifying their specific contents related to her figure. The third delves into some contemporary contributions of (...) a literary, historiographical and philosophical nature. To this purpose I will recover the literary appreciations of Octavio Paz, the historical proposals of Matthew Restall, and the philosophical approach of Bolívar Echeverría. The fourth section functionalizes some final considerations related to Malintzin as useful perspective to problematize the contemporaneity of the conquest of Mexico. Lately, this article seeks to ask and reflect on Malintzin in terms of the construction of an imaginary that posits a multidirectional understanding of her figure. (shrink)

Este trabajo pretende dejar de manifiesto la existencia de una figura o estructura teórica dentro de la obra del marxista latinoamericano Bolívar Echeverría, que muestre su organicidad interna y lógica argumental. A través de cuatro momentos, se recorre la totalidad de su producción teórica, siguiendo dos elementos estructurales; por un lado, el modo especifico en que el autor leyó la "crítica de la economía política" de Karl Marx, y, por el otro, su intento por desarrollar una crítica a la (...) modernidad capitalista desde la cultura política, a partir de los fundamentos de su lectura de Marx. This work tries to show the existence of a figure or theoretical structure within the work of the Latin American Marxist Bolívar Echeverría, which shows its internal organicity and logical argument. Through four moments, the entirety of its theoretical production is covered, following two structural elements; on the one hand, the specific way in which this author read Karl Marx's critique of political economy, and, on the other, his attempt to develop from it, a critique from political culture to capitalist modernity. We examine a condition in which units of time, such as months of the year, are associated with specific locations in space. For individuals with this time-space synaesthesia, contiguous time units such as months are spatially linked forming idiosyncratically shaped patterns such as ovals, oblongs or circles. For some individuals, each time unit appears in a highly specific colour. For instance, one of the synaesthetes we studied experienced December as a red area located at arms length to the left of (...) their body. For the same individual May was a blue area located roughly at arms length to the right of their body. We studied four synaesthetes who report spatial associations for the months of the year. We found that the time-space associations experienced by these individuals were consistent across test–retest. In addition, month names directed visual attention to particular locations in space. For some synaesthetes, this directing of spatial attention was quite rapid-in accord with their reports that month names involuntarily bring to mind spatial locations. (shrink)

Kant's main contentions in this part of his work can be summed up in; two propositions: human understanding contains certain a priori concepts, and on these are based certain non-empirical principles; these concepts are only general concepts of a phenomenal object, and therefore the principles in question are only prescriptive to sense-experience. The literary genesis of Einbahnstraße by Walter Benjamin represents a very special case of the use of the procedures of surrealism in the philosophical-literary production of the author. The process of evolution of thinking that ended up in the writing of this piece is unveiled throughout the present analysis. This is a sign of both waiver and restart; the opening for a new productive dimension in the career of one of the most important —and misunderstood— philosophers of the 20th century. (...) More than enlightening a small master piece of philosophy from a literary perspective, or analyzing a small master piece of literature from the philosophy, what is being problematized here is the division, cultivated or figured throughout the years, between both disciplines. This paper deals with the question of whether uncertainty regarding model structure, especially in climate modeling, exhibits a kind of “chaos.” Do small changes in model structure, in other words, lead to large variations in ensemble predictions? More specifically, does model error destroy forecast skill faster than the ordinary or “classical” chaos inherent in the real-world attractor? In some cases, the answer to this question seems to be “yes.” But how common is this state of affairs? Are there precise mathematical (...) results that can help us answer this question? And is dependence on model structure “sensitive” in that arbitrarily small errors can destroy forecast skill? We examine some efforts in the literature to answer this last question in the affirmative and find them to be unconvincing. (shrink)

In this essay I revise, based on the notion of the ‘enlightened ruler’ or mingzhu and his critique of the literati of his time, the common belief that Han Fei was an amoralist and an advocate of tyranny. Instead, I will argue that his writings are dedicated to advising those who ought to rule in order to achieve the goal of a peaceful and stable society framed by laws in accordance with the dao.

Argumentation represents a way of reasoning over a knowledge base containing possibly incomplete and/or inconsistent information, to obtain useful conclusions. As a reasoning mechanism, the way an argumentation reasoning engine reaches these conclusions resembles the cognitive process that humans follow to analyze their beliefs; thus, unlike other computationally reasoning systems, argumentation offers an intellectually friendly alternative to other defeasible reasoning systems. LogicProgrammingisacomputationalparadigmthathasproducedcompu- tationallyattractivesystemswithremarkablesuccessinmanyapplications. Merging ideas from both areas, Defeasible Logic Programming offers a computational reasoning system that uses an argumentation engine (...) to obtain answers from a knowledge base represented using a logic programming language extended with defeasible rules. The thought of Pierre Klossowski, praised by Foucault, Blanchot, Deleuze, has been scarcely addressed by the philosophical community. We argue in this article that this is largely due to the frequent difficulty of understanding his work as a whole: both his artistic and literary production and his interpretations of Nietzsche or Sade form a coherent whole, whose significance has a deeply critical political scope. The notion of unproductive spending, which occupies a central place in Bataille's work, will be rearticulated in (...) Klossowski's reflections through the concepts of drive, phantasm, simulacrum, value and consumption. In The Living Currency, the political dimension of these terms appears clearly: relying on a rereading of Fourier and Sade, the author shows the extreme degree of deformation of what we assume as a reality in modern industrial society. In this sense, his thinking takes on special relevance today, as a revelation of the excess and unhingedness of a society in which production and consumption are reproduced without limit through the infinite reflections produced by the game between drives, ghosts and simulacra. Citizenship regimes are institutionalized systems of formal and informal norms that define access to membership, as well as associated rights and duties. This paper studies illegalized migration as one of the major tests to assess whether citizenship regimes are fair institutions, based on a historical analysis of legislation meant to reduce illegalized migration in the United States between 1995 and 2022. We build our empirical research starting from a simple observation: despite the great number of bills introduced to reduce illegalized (...) migration to the US, most of such initiatives fail to become law. In fact, 93.5% of all immigration initiatives did not even pass the chamber of Congress in which they were originally presented. Such a high rate of failure shows that these proposals are motivated by electoral aspirations, rather than coming from a genuine wish to help migrants or grant them citizenship. Furthermore, there is also an economic interest that justifies the maintenance of low-cost disposable immigrant labor, with no right to citizenship. Our analysis is an example of how state regulation processes seem to work to formalize, rather than alleviate or eradicate, the precarious legal statuses of illegalized migrants. We conclude that a globalized phenomenon such as citizenship requires going beyond merely institutional and formal conceptions. We need to rethink the institutional notion of citizenship, as a merely status held under the authority of a state and consider it from a cosmopolitan perspective and a multilateral basis. But as long as citizenship remains under the responsibility of states, illegalized migrants will continue to experience precarious citizenship. (shrink)

In a recent issue of the Journal of Business Ethics, Filipe M. Santos posits that social entrepreneurs maximize not on value capture, but on value creation, only satisficing on value capture to fuel operations, reinvesting in growth, whatever the specific combination of institutional means is deemed appropriate. No doubt the analytical framework of value creation and value capture casts new light on the phenomenon of social entrepreneurship, but we think Santos is asking too much by advocating a shift in focus (...) away from the organization. On the contrary, we maintain that by refocusing the theory on the organizational level and away from the system it is possible to understand that not all organizational solutions available to social entrepreneurs are able to create value and not all value capture strategies can serve a social goal. Indeed, there is only one form of organization that fulfills the criteria of maximizing on value creation, while satisficing on value capture and that is the social enterprise. (shrink)

This paper critically explores the ethical dimensions of Behavioral Public Policy (BPP), a domain grounded in the understanding that human rationality is bounded and that this limitation often leads to behaviors deemed irrational. By applying the behavioral lens, which posits that people operate under bounded rationality, BPP aims to craft interventions that safeguard individuals against their biases. However, this approach raises significant ethical concerns, both in the scientific underpinnings of BPP and its application through policy interventions. Accordingly, this paper examines (...) two distinct ethical dimensions of BPP, both as a scientific discipline and through its intervention methodologies. The analysis of the first dimension argues that, viewing bounded rationality as only instrumental in decision-making processes, risks oversimplifying ethical complexities. Such simplification may ignore the moral and value-based rationalities underlying decisions, potentially misattributing instances of immorality and akrasia (the failure to act according to one's judgment) to mere deficiencies in rational thinking. Secondly, the paper examines the impact of BPP on moral behavior and character development, addressing ethical concerns like the evidentiary basis of BPP research, the bounded rationality of choice architects themselves, and the morality of behavior changes induced by policy. Overall, this article provides a much-needed examination of the moral considerations associated with behavioral strategies in public policy and its epistemological foundations, contributing to a more comprehensive understanding of their ethical implications .
